At an Aug. 6 Senate Homeland Security and Governmental Affairs Committee hearing, Anthony Fauci invoked the Fifth Amendment as Sen. Rand Paul questioned him about COVID-19 origins, NIH-funded coronavirus research and pandemic-era records. Paul, the committee’s Republican chair, said Fauci’s refusal to answer left open Justice Department scrutiny despite President Joe Biden’s preemptive pardon covering earlier COVID-related conduct. The legal issue is whether Fauci faces exposure for any post-pardon statements, contempt disputes or matters outside the pardon’s scope, rather than for pardoned conduct.
