What happened
A Staten Island state judge ordered New York City to cancel pied-à-terre tax notices and redo the luxury second-home surcharge rollout. A separate lawsuit by Steve Wynn and former Commerce Secretary Wilbur Ross argues the tax is unconstitutional because it discriminates against nonresidents. The ruling case challenged the city’s administration, not whether the tax itself is legal. Mayor Zohran Mamdani and Gov. Kathy Hochul had made the levy central to raising revenue from wealthy nonprimary-home owners. Suing homeowners said the rollout caused confusion and privacy concerns. The judge said the city listed properties and mailed notices without properly deciding which homes owed the tax. The city plans to appeal and seek a stay.
